The purpose of these general terms and conditions of sale is to specify the terms and conditions for online purchases of products, in particular our Tarah Blanche products, on the http://www.tarahblanche.com/ website.

ARTICLE 1 - PRICES

The prices of our products are indicated in euros, all taxes included, eco-participation included, except for processing and shipping costs (see shipping / delays and costs). Rose and Blue reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of your order validation. The products remain the property of Rose and Blue Sarl/ Tarah Blanche until full payment has been received by Rose and Blue/Tarah Blanche.

ARTICLE 2 - ORDERING

You can place your orders on the Internet on the http://www.tarahblanche.com/ website. The contractual information is presented in the French language and will be the subject of a confirmation containing this contractual information at the latest at the time of validation of the order.

ARTICLE 3 - VALIDATION

You declare that you have read and accepted these general terms and conditions of sale before placing your order. The validation of your order therefore implies acceptance of these General Conditions of Sale. In the absence of proof to the contrary, the data recorded by Rose and Blue/Tarah Blanche constitutes proof of all transactions between Rose and Blue/Tarah Blanche and its customers.

ARTICLE 4 - AVAILABILITY

Rose and Blue/Tarah Blanche is a retailer and does not sell large quantities of the products offered. Consequently, Rose and Blue/ Tarah Blanche reserves the right to refuse orders of the same product in large quantities, starting from 5 identical items. Our product offers are valid as long as they are visible on the website, within the limits of available stocks, except for promotional operations mentioned as such on the websites. In the event that a product is not available after you have placed your order, we will inform you by e-mail. Your order will then be automatically cancelled and you will be immediately refunded if your bank account has been debited.

ARTICLE 5 - DELIVERY

5.1 - Generalities

The products purchased on the company Rose and Blue/ Tarah Blanche cover the following territories: Metropolitan France, Corsica, Monaco, EEC, Norway, Switzerland, United Kingdom, Japan, Australia, Canada, United Arab Emirates, Russia.

The delivery deadline corresponds to the shipping time indicated on the article sheet, plus the processing time and the delivery time. The products are delivered to the delivery address that you indicated during the ordering process at the latest on the date indicated on the payment page before validation of the order.

In case of delivery by a carrier requiring an appointment with the customer, the latter will contact you as soon as possible to agree with you on a delivery appointment, 30 days at the latest from the date of your order validation. The company Rose and Blue/Tarah Blanche cannot be held responsible for any delay in delivery due exclusively to the client’s unavailability after several proposed appointments by the carrier.

When you order several products at the same time and they have different delivery dates, the delivery date is based on the most distant date. However, Rose and Blue/Tarah Blanche reserves the right to split shipments. Only the shipped products will be charged. The contribution to the processing and shipping costs will only be invoiced for one shipment.

In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences for the delivery date indicated to you. In the event of a delay in delivery, we will propose a new delivery date by e-mail. In any case, in the event of a delay of more than 7 days, you have the possibility of cancelling your order within 60 working days, in accordance with legal provisions. In this case, if you have received the product after your cancellation, we will proceed to the reimbursement of the product and the return costs, upon receipt of the product by us, complete and in its original condition.

In the case of payment by credit card or private card and split deliveries, only the products shipped are debited. In the case of payment by cheque, the order will only be processed upon receipt and cashing of the cheque.

5.2 - Reservations

You must notify the carrier and the company Rose and Blue/Tarah Blanche of any reservations about the product delivered (for example: damaged package, already opened...). Depending on the cases defined in article 13.1 below, you can benefit from the exchange and refund conditions provided for in this article.

ARTICLE 6 - PAYMENT

Payment for your purchases is made by bank cards: Visa, MasterCard, other blue cards. The card is only debited when the order is shipped.

ARTICLE 7 - REFUNDS

Refunds will only be made after validation of this procedure:

- Notification of the return by e-mail and the reason for the return.

- Acceptance of the return by the company Rose and Blue/Tarah Blanche.

- Receipt of the return by Rose and Blue/ Tarah Blanche.

Refunds of products in the cases mentioned in articles 5 and 8 will be made as soon as possible and at the latest within 14 days following the date on which the right was exercised.

The reimbursement shall be made at the suggestion of the company Rose and Blue/Tarah Blanche by crediting its bank account or by bank cheque sent in the name of the customer who placed the order and to the billing address, the customer being able to opt for another method of reimbursement than the one proposed.

ARTICLE 8 - SATISFIED OR YOUR MONEY BACK 14 DAYS - RIGHT OF WITHDRAWAL

In accordance with the legal provisions in force, you have a period of 14 days from receipt of your products to exercise your right of withdrawal from the company Rose and Blue without having to justify your reasons or pay any penalty.

In case of exercising the right of withdrawal within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be reimbursed; the return costs remain at your charge.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be marketed as new, and accompanied by a copy of the purchase invoice for optimum management.

For a purchase made in a shop, this commitment is different from that made for a purchase made on our website.

The address for the return of the product is the head office of the company Rose and Blue/ Tarah Blanche, namely 9, rue de Budapest 75009 Paris.

In this respect and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorised, subject to different, even more restrictive provisions of the Intellectual Property Code. Any reproduction or representation, in whole or in part, of the Rose and Blue/Tarah Blanche websites or of all or part of the elements found on the Rose and Blue/Tarah Blanche websites is strictly forbidden.

The company names, trademarks and distinctive signs reproduced on the Rose and Blue/Tarah Blanche websites are protected under trademark law. The reproduction or representation of all or part of one of the aforementioned signs is strictly forbidden and must be subject to prior written authorisation from the trademark holder.

Certain products, such as software, are subject to personal and specific rights of use that regulate copying, public distribution and rental. You must respect the general terms and conditions of sale of these products and Rose and Blue/Tarah Blanche cannot be held responsible for any use that may be made of the products in this context.

ARTICLE 11 - LIABILITY

The products offered are in accordance with current French legislation and the standards applicable in France. The responsibility of the company Rose and Blue/Tarah Blanche cannot be engaged in case of non-respect of the legislation of the country where the product is delivered (for example in case of prohibition of a product...). It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you are considering ordering.

The photos are provided for illustrative purposes only. We invite you to refer to the description of each product to know the precise characteristics; and, in case of doubt, or if you wish additional information, do not hesitate to contact our Customer Service.

The company Rose and Blue/Tarah Blanche is only responsible for the content of the pages it publishes.

In case of professional purchases, Rose and Blue/Tarah Blanche shall not be held liable for any indirect damage, operating loss, loss of profit, loss of opportunity, damage or expenses that may arise from the purchase of the products. We remind you that it is prudent to proceed with the backup of the data contained in the purchased products. Rose and Blue/Tarah Blanche shall not be liable for any loss of data, files or damage as defined in the previous paragraph. The total or partial impossibility to use the products, in particular due to hardware incompatibility, shall not give rise to any compensation or reimbursement or to any liability on the part of Rose and Blue/Tarah Blanche. Our products have performances compatible with professional uses even if Rose and Blue/ Tarah Blanche is not intended to sell to professionals. Consequently, Rose and Blue/Tarah Blanche shall not be held liable for any damage whatsoever resulting from a professional activity.

ARTICLE 12 - WARRANTY

12.1 - Legal guarantee

In accordance with the legal provisions in force, relating to the conformity of the goods to the contract and in particular those specified in the appendix to the present conditions, we will reimburse you or exchange the products that appear to be defective or do not correspond to your order. The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions...). Any damaged or worn product cannot be reimbursed and will be returned to you at your expense.

You also benefit from the legal guarantee against hidden defects in accordance with the legal provisions specified in the appendix to these conditions.

The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in article 8.

12.2 - Contractual guarantee

The products purchased on the http://www.tarahblanche.com/ website may give the right to a contractual guarantee. This is indicated on the article sheet of the products presented on the site. In order to know the steps to follow, you can contact the Customer

In order to benefit from the contractual guarantee of the products, it is imperative to keep the purchase invoice of the product.

The contractual guarantees do not cover

Abnormal or improper use of the products. In this respect, we invite you to carefully consult the instructions for use and in particular for maintenance provided with the products,

Defects and their consequences linked to use that is not in accordance with the use for which the product is intended (professional, collective use, etc.), defects and their consequences linked to any external cause.

In any case, you benefit from the provisions of the legal guarantee and in particular those specified in article 13.1 above.

ARTICLE 13 - APPLICABLE LAW - DISPUTES

This contract is subject to French law. The language of this contract is French. In the event of a dispute, the French courts shall have exclusive jurisdiction. In the event of a dispute with professionals and/or merchants, the courts of Paris (France) shall have jurisdiction.

ARTICLE 14 - PERSONAL DATA

The information and data concerning you are necessary for the management of your order and for our commercial relations. It may be transmitted to companies that contribute to these relations such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you.

Annex

Article L.211-4 Consumer Code

The seller is obliged to deliver goods in conformity with the contract and is responsible for any lack of conformity existing at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

Article L.211-5 Consumer Code

To be in conformity with the contract, the goods must:

1° Be fit for the purpose usually expected of similar goods and, where applicable

correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

Article L.211-12 Consumer Code

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

Article 1641 Civil Code

The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price, if he had known about them.

Article 1648 paragraph 1 Civil Code

The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect.
